Understanding
I. The terms and conditions below apply to coaching services provided by Glenn Sabin through FON Therapeutics, Inc. (FTI) to any individual and constitute the contract for the service to be provided by FTI for the client. The term 'coaching' as used here is specific to cancer coaching.
II. Glenn Sabin is not a medical doctor, licensed dietician, nutritionist, psychologist, or other type of licensed, registered medical professional. The services provided by Glenn Sabin and FON Therapeutics, Inc. are for informational purposes only and are not intended to replace or substitute any professional, medical, legal, or other advice.
III. FTI does not provide health care, medical care or therapy services and will not diagnose, treat or cure any disease, condition or psychological ailment. Glenn Sabin and FTI encourage you to continue to be seen and treated by your healthcare professionals including your physician.
IV. The date that the first coaching session takes place shall be deemed to be the start date for the service. Participation by client in the first coaching session constitutes acceptance of these terms and conditions.
Responsibility & Commitment
V. Glenn Sabin and FTI will seek to enable the client to set and achieve goals that will help to bring about desired outcomes for the client. The client has sole responsibility for any decisions they may make following coaching with FTI. FTI disclaims any and all liability concerning any treatment or action by any person following the information provided by FTI, whether justified or otherwise, to achieve a material improvement in quality of life or to achieve their desired outcomes or goals.
Confidentiality
VI. Personal information supplied to FTI by the client in coaching sessions will be treated as confidential. It will not be disclosed to a third party without the client's prior permission, save where required by law.
Coaching Procedure
VII. Client must first complete FTI’s intake questionnaire form and electronically sign the terms and conditions page.
VIII. The coaching schedule will be arranged between FTI and the client and can be booked up to 12 months in advance, depending on the chosen coaching ‘program’, using the automated calendar scheduler.
IX. The number of coaching sessions are determined by the coaching ‘program’ client chooses.
X. The length of a Comprehensive Cancer Coaching Consultation is 75 minutes. Each session included in the 6 Month Coaching Program and 12 Month Coaching Program bundles are 30 minutes in length.
XI. Coaching will take place between the client and Glenn Sabin via Skype or by telephone (client calls coach if outside the United States).
XII. FTI may assign the client tasks or exercises to complete between coaching sessions. There is no obligation for the client to complete these tasks, but not doing so may slow the client's progress in gaining improved quality of life or achieving desired outcomes.
XIII. The client may contact FTI by email between sessions to share a success or seek clarification on a coaching issue. Support between sessions is seen by FTI as a necessary part of the coaching process. FTI will always advise a client in advance if the nature of a client's inquiry is likely to incur an additional charge, and no such charges will be imposed without the client's agreement.
Costs and Payments
XIV. The fees of all services and programs will be as quoted on our website.
XV. Payment for (75 min) Comprehensive Cancer Coaching Consultations (CCC) will be debited via PayPal prior to the session.
XVI. Clients who purchase the 6 Month Coaching Program and 12 Month Coaching Program bundles will be debited via PayPal in equal monthly payments spread out over the term of the agreement, following the initial CCC. Following is an illustration of the payment schedule:
- May 28: Client books 6 Month Coaching Program bundle
- May 28: Payment is processed for $325 for CCC; session is booked for June 5
- June 6: Credit card is debited for the first of 5, 30-min sessions, and continues to be debited on the 6th day of each month until program is paid in full.
XVII. A paid invoice will be sent via PayPal after each debit, to the email address provided by client.
Cancellation & Rearranging Sessions
XVIII. If client needs to rearrange a Comprehensive Coaching Consultation, they must provide no less than 48 hours’ notice of cancellation. No refunds will be given to client for unused Comprehensive Coaching Consultation sessions unless 48 hours’ notice of cancellation has been given. ‘Bundled’ program clients must provide no less than 24 hours’ notice for canceled appointments. Except under exceptional circumstances, solely determined by FTI, no refunds will be given if client fails to (1) provide required amount of cancellation notice or (2) upon providing required cancellation notice fails to reschedule Comprehensive Coaching Consultation or ‘Bundled’ program session(s) within 14 days from original booked date. In exceptional circumstances FTI may need to rearrange a coaching session; in these circumstances FTI will use its best effort to provide the client a mutually satisfactory alternative appointment date and time.
XIX. The client may terminate their 6 Month Coaching Program and 12 Month Coaching Program bundles contract at any time in writing, with NO PENALTY, so long as no less than 30 days’ notice is provided in advance of their next billing period.
XX. In exceptional circumstances, such as illness or unavailability due to bereavement or other commitments, inappropriate behavior by the client, actual or potential conflict of interest, or other reasons, FTI can decide to terminate the service to the client early or refuse or be unable to provide further coaching sessions to the client. In such a circumstance the client will be given reasonable notice of termination by FTI where practicable, and will be refunded any advance payments made for coaching sessions not yet provided.
XXI. There may be occasions when FTI may recommend to the client that they seek an alternative service more suited to their current needs. In this event FTI will fully discuss the reasons for the recommendation with the client. It is the client’s sole responsibility to decide whether to follow the recommendation and FTI does not accept any liability for the outcome of any decisions the client chooses to make.
Entire Agreement
XXII. These terms and conditions represent the entire agreement between FTI and client, supersedes any prior agreement, understanding or arrangement, whether verbal or in writing.
XXIII. FTI reserves the right to revise and amend these terms and conditions from time to time to reflect changes in market conditions affecting our service, changes in technology, changes in payment methods, changes in relevant laws and regulatory requirements and changes in our system's capabilities.
XXIV. Client will be subject to the terms and conditions at the time that they sign up for any program from FTI, unless we notify the client of the change to these terms and conditions at which point the client will be asked to re-sign said terms and conditions.
By electronically signing your name and clicking the “SUBMIT” button, you agree to accept these terms and conditions and the provisions concerning the use of electronic signatures. You also warrant that you are at least 18 years and legally capable of entering into binding agreements.
